Todd Kantorczyk is a partner at the environmental and energy law firm of Manko, Gold, Katcher & Fox. He has extensive experience advising clients on complex issues related to regulatory compliance, litigation, and transactional matters, particularly in the areas of wetlands and stormwater permitting, chemical regulation, air, climate change, and energy.  Todd’s practice has included matters related to chemical regulation under the Toxic Substances Control Act, as well as natural gas production in the Marcellus Shale Region and associated infrastructure development, including cutting-edge issues affecting the regulation of upstream and midstream natural gas operations under federal and state air quality and water resource programs.  He serves as the firm’s liaison to the Marcellus Shale Coalition and is an active participant in that group’s Air Quality subcommittee.  

Todd has frequently lectured and written on issues related to wetlands and stormwater permitting, evolving chemical regulation, natural gas production, climate change and air related issues for The Legal Intelligencer, the Pennsylvania Bar Institute, the Philadelphia Lawyer, and other publications and organizations.

Away from work, Todd serves as the President of the School Board Director for the award-winning Tredyffrin/ Easttown School District.  He also enjoys fostering service dogs in training and staying healthy through CrossFit.

Todd has represented industrial and commercial concerns, ranging from Fortune 100 corporations to closely held entities, in complex matters including the following:

  • represented a responsible party in negotiations with USEPA, NJDEP, local governments, other potentially responsible parties, and potential developers at two former industrial sites in Kearny, New Jersey;
  • assisted midstream partnership with environmental permitting and enforcement matters associated with construction of a multi-billion-dollar natural gas liquid pipeline across Pennsylvania;
  • assisted chemical manufacturer with a USEPA audit and inspection concerning compliance with a Consent Order issued under Section 5(e) of the Toxic Substances Control Act (TSCA) regarding premanufacture notices associated with an emerging contaminant; 
  • provided counsel to a major natural gas midstream operator concerning cutting-edge air quality issues such as single source aggregation, developing New Source Performance Standards, applicability of New Source Review regulations, and revised state air permitting programs;
  • advised several major natural gas companies active in the Marcellus Shale region regarding the effect of comprehensive amendments to Pennsylvania’s Oil and Gas Act (Act 13) and implementing regulations; 
  • drafted an industry group response to a petition requesting that USEPA subject the oil and gas extraction industry to Toxic Release Inventory reporting under the Emergency Planning and Community Right to Know Act;
  • resolved compliance and permitting issues for a major petroleum refinery that implicated New Source Review, New Source Performance Standards, National Emissions Standards for Hazardous Air Pollutants and Title V permitting issues;
  • coordinated environmental response activities subject to an indemnity agreement at dozens of industrial sites worldwide, including Superfund sites, RCRA corrective action sites, and state-led cleanup sites; and
  • negotiated a consent order with USEPA in response to alleged Clean Water Act violations at a petroleum marketing terminal.
