Campbell will review the current state of the law concerning the relationship between private cost recovery and contribution under CERCLA, including when a private party may bring a contribution claim versus a cost recovery claim, as well as the practical differences between cost recovery and contribution. She will also address what remains unresolved by the courts in this area, and possible incentives and ramifications for private-party cleanups on a going-forward basis.
