EPA Publishes List of Highest Priority RCRA Sites

The U.S. Environmental Protection Agency's ("EPA's") Resource Conservation and Recovery Act ("RCRA") Corrective Action Program recently published a list of 1,968 highest priority RCRA sites. As such, EPA pledged to select a final remedy at 36% of the sites, and put a final remedy in place at 27% of the sites, by 2008. The list may be found at http://www.epa.gov/correctiveaction/08ca_bln.pdf. Although many of the sites are actively pursuing corrective action compliance, the responsible parties at others likely believed they were in compliance with their corrective action obligations via participation in a state-lead voluntary cleanup program ("VCP"). In such cases, responsible parties should confirm with EPA their participation in the VCP and encourage coordination between the agencies.
