EPA Publishes List of Highest Priority RCRA Sites
The U.S. Environmental Protection Agency's ("EPA's") Resource Conservation and Recovery Act ("RCRA") Corrective Action Program recently published a list of 1,968 highest priority RCRA sites. As such, EPA pledged to select a final remedy at 36% of the sites, and put a final remedy in place at 27% of the sites, by 2008. Although many of the sites are actively pursuing corrective action compliance, the responsible parties at others likely believed they were in compliance with their corrective action obligations via participation in a state-lead voluntary cleanup program ("VCP"). In such cases, responsible parties should confirm with EPA their participation in the VCP and encourage coordination between the agencies.
